Electronic access to the National Court Register

Search engine of entities entered in the National Court Register.

The search engine allows to find information on an entity entered in the National Court Register. It is possible to search by KRS entry number or the entity’s name.


Electronic access to Register Courts/the Central Information/the Court and Commercial Gazette (MSiG).
The ‘Electronic access to Register Courts/the Central Information/the Court and Commercial Gazette (MSiG)’ module allows to:

  • file and submit motions, attachments and documents to Register Courts or the Central Information of the KRS via electronic means,
  • receive correspondence from courts or the Central Information of the KRS.
  • Requirements for the proper operation of the ‘Electronic access to Register Courts/the Central Information/the Court and Commercial Gazette (MSiG)’:
  • a secure electronic signature verified by a valid qualified certificate issued by a qualified certification service provider entered in a register kept by the National Certification Centre
  • documents submitted in electronic form as an electronically signed file in one of the following formats: pdf (with the option to print), doc, odt, txt, rtf.

The provisions of the Act of 20 August 1997 on the National Court Register (Journal of Laws of 2007, no. 168, item 1186, as amended) provide the possibility to use electronic means to file a motion for an entry (or amendment of an entry) to the register of any entity, which is subject to entry to the KRS. Article 19 s. 1 and 2 of the Act state that the motion is to be filed on an official form and do not impose restrictions on the way it is submitted to the register.
This means that there is no need to set up a special account in an ICT system and the only requirement for the use of the Internet is that the authorised persons have and employ secure electronic signatures verified by a valid qualified certificate. The possibility to use an ICT link is expressly indicated by Article 19 s. 2b of the aforementioned Act, which states that motions filed via electronic means should be supplemented with a secure electronic signature verified by a valid qualified certificate (an exception is a S24 company, whose entry to the register may also be supplemented with another electronic signature and also its registration requires setting up a special account in an ICT system).


It should be noted that, when employing this procedure, only the signature templates of persons authorised to represent the entity cannot be submitted electronically (due to the nature of such documents). It is however possible to submit in this manner notarial deeds if the notary supplemented them with a secure electronic signature verified by a valid qualified certificate (article 6944 § 3 of the Civil Procedure Code).

 

Legal considerations:
1) The issue of copies, excerpts, certificates and provision of information by the Central Information is regulated by article 4 of the Act on the National Court Register.
2) The form of copies, excerpts, certificates, information and photocopies of documents served on the petitioners via electronic means is regulated by:

  1. § 6 of the ordinance of the Minister of Justice of 22 December 2011 on the organisational and technical conditions relating to the form of motions and documents as well as their submitting to Register Courts and the Central Information of the National Court Register via electronic means and the use of documents issued in electronic form,
  2. § 25 of the ordinance of the Minister of Justice of 27 December 2011 on the system and organisation of the Central Information of the National Court Register and the procedure and mode of provision of information from the National Court Register and issue of copies of documents from the catalogue as well as the structure of the provided information on entities entered in the Register and properties of print-outs allowing for their cross-referencing with the data in the Register.
